(Bloomberg) -- A former Citigroup Inc. broker's claims that she was demoted because of her gender and fired for reporting a superior for violating rules designed to prevent insider trading is heading for arbitration.
A federal judge on Tuesday granted the bank's request to send Erin Daly's complaint to arbitration. The former broker sued the bank in November 2016. She said she was reduced to a "glorified secretary" because of her gender and terminated after reporting a superior had demanded to be given protected information to give to favored clients.
U.S. District Judge Richard J. Sullivan also granted the bank's request to throw out Daly's Sarbanes-Oxley whistle-blower claim, saying she didn't file a complaint about the alleged retaliation with the Occupational Safety and Health Administration for two years after she was terminated, well after the 180-day requirement had passed.
The case is Daly v. Citigroup Inc., 16-cv-09183, U.S. District Court, Southern District of New York (Manhattan).
