The Supreme Court on Wednesday agreed to set up a five-judge Constitution bench to hear pleas related to Aadhaar on July 17-18, including the one on right to privacy.
Chief Justice of India JS Khehar agreed to set up the bench after Senior Advocate Shyam Divan and Attorney General of India KK Venugopal made a joint request. The bench will hear the preliminary issue of privacy and also whether the case needs to be referred to a larger bench. Both the parties will get one day each to make their arguments.
The request was mentioned by both parties after a three-judge bench last week directed them to do so in front the Chief Justice.The bench at that time was hearing petitions challenging Aadhaar being made mandatory for the government's social welfare schemes.
The bench had then said that all the issues related to Aadhaar must be decided by the Constitution bench and asked both the parties to approach the Chief Justice.
