Zee Entertainment Enterprises will seek an expanded undertaking from Nykaa in the Delhi High Court to prevent any future copyright infringement, while continuing to press its claim for Rs 2 crore in damages, in an ongoing copyright dispute, sources close to the case told NDTV Profit.
The lawsuit was filed on April 3 before the Delhi High Court. Zee has alleged that Nykaa's use of its music in promotional reels violated copyright law as well as licensing terms applicable to music use on Meta platforms such as Instagram.
Nykaa has informed the court that all 12 reels identified by Zee have already been removed.
The broadcaster remains unsatisfied with the scope of the undertaking currently recorded by the court, which is restricted to the takedown of 12 specific Instagram reels flagged by Zee as infringing its copyright.
Zee has argued that the existing undertaking is insufficient and does not adequately protect its rights. The company wants the court to direct Nykaa to give a broader assurance that it will not use any part of Zee's music repertoire without authorisation, instead of limiting compliance to the specific reels already identified.
Zee fears that a narrow, reel-specific undertaking leaves the door open to repeat violations. It has flagged the risk of further unauthorised use of its songs in promotional material unless the undertaking extends to its full music catalogue.
Alongside its request for a wider injunction, Zee is pursuing damages of Rs 2 crore, alleging that Nykaa's actions have caused commercial harm. The broadcaster has accused the beauty and lifestyle retailer of using Zee-owned songs in social media promotions without proper authorisation.
Nykaa has not admitted wrongdoing and has relied on compliance through takedowns of the content flagged so far.
The Delhi High Court is scheduled to hear the matter next on May 26.
