There are no grey areas in the Supreme Court's judgment that real power rests with the council of ministers in Delhi and not the Lieutenant Governor, said Senior Advocate in the apex court, KTS Tulsi.
“This judgement appears to be the strongest indictment of the BJP government at the Centre,” Tulsi told BloombergQuint in an interview. According to him, the state government's decision on all state subjects besides police, land and public order is binding on the Lieutenant Governor. The apex court's judgment is an affirmation that there is no question of the LG interfering in the governance of the National Capital Territory, said the senior advocate.
The Supreme Court today ruled that the Lieutenant Governor cannot act as an obstructionist in policy decisions of the union territory.
