Mohammed Shami's Wife Hasin Jahan Wants Maintenance Cases To Be Transferred To Delhi, Moves Supreme Court

Indian cricketer Mohammed Shami's wife, Hasin Jahan, has approached the Supreme Court seeking the transfer of her ongoing domestic violence and maintenance cases from Kolkata to Delhi.  

The petition, filed recently, requests the apex court to shift the cases citing convenience and accessibility, as her current residential address is in the national capital.

The case was heard by a two-judge bench, comprising Justices Manoj Misra and Manmohan. Hasin stated that she moved to Delhi to provide their daughter with a better education at a good school and to support her overall growth and development, according to Bar and Bench.

Currently, her cases are filed in West Bengal, and she said it is difficult for her to travel there regularly. 

"Thus, under such circumstances, compelling the petitioner to contest the cases in West Bengal, which is 1,500 kms away from Delhi, shall cause grave prejudice and hardships to the petitioner and minor daughter," the petition read. 

Hasin pointed out that Shami travels internationally for his work and has enough resources to handle the legal cases in Delhi, whereas she does not have an independent income and is responsible for the maintenance cost their daughter's day-to-day care. 

Hasin said she has not worked since her marriage and relies completely on maintenance from Shami to support herself and their daughter. 

She also stated that Shami's family lives in Uttar Pradesh, which is closer to Delhi than to Kolkata and will be easier for Shami to attend legal proceedings.

Shami and Hasin got married in 2014, but the two have been in a legal dispute since 2018. His wife has made allegations of domestic abuse and dowry harassment against Shami.  

In the petition, Hasin alleged that Shami tried to avoid his responsibility to support his family. She claimed that Shami continued to live a luxurious life and donated crores to social causes, while he didn't provide adequate financial support to his own family. 

She also claimed that their daughter's education has suffered because she had to attend a modest local school. The petition also points out Shami's luxury cars, including a Range Rover, a Jaguar, a Mercedes, and a Toyota Fortuner.  

"Despite his financial capacity, the child has been compelled to attend a modest local school, unlike children of similarly placed families who receive premium education," the petition read. 

The Calcutta High Court had earlier granted Hasin Rs 1.5 lakh per month for herself and Rs 2.5 lakh per month for their daughter. She has now challenged this amount, asking for a higher monthly maintenance of Rs 7 lakh for herself and Rs 3 lakh for their daughter. 

The petition showed that Shami's annual income (from his 2021-22 Income Tax Return) is nearly Rs 48 crore. Despite this, she claims she has been living in poor conditions, struggling to pay for even basic expenses.
