(Bloomberg) -- Justice Brett Kavanaugh will be on the U.S. Supreme Court bench for arguments Tuesday after taking part by phone last week because of a positive Covid test, a spokeswoman said.
Kavanaugh, who like the other justices is fully vaccinated, had been working from home after testing positive on Sept. 30. He participated remotely in five arguments last week.
The court is hearing two cases Tuesday, including a clash stemming from a Kentucky law that would sharply restrict abortion after the 15th week of pregnancy. At issue is whether the state's Republican attorney general can take over the defense of the law after a Democratic official decided not to press an additional appeal.
