Federal Crypto Oversight: US CFTC Proposes New Framework For Leveraged Trading

The United States Commodity Futures Trading Commission has proposed a broad federal regulatory framework for cryptocurrency exchanges that offer leveraged or margined trading of digital assets. Posted October 5, 2026, by CFTC Chairman Michael S. Selig, the proposed rules introduce an optional federal oversight regime designed to bypass the traditional state-by-state licensing structure.

The Commodity Futures Trading Commission's proposed rules would effectively allow US virtual currency exchanges to adopt a federal regulatory regime to operate money transfer companies, rather than relying primarily on a patchwork of state licenses, the agency said.

Exchanges that choose the new structure will already be subject to a single set of federal rules, rather than a disparate state-by-state regulatory regime that many consider too cumbersome, reported Reuters.

The proposed rules make use of a specific authority the CFTC has to oversee margined or leveraged spot assets. The CFTC has long sought authority to regulate the spot cryptocurrency markets, which currently operate in a regulatory grey area, but only ‌Congress has the ability to provide the regulator with that purview.

"For years, entrepreneurs building on the new frontier of finance faced uncertainty about whether there was a place for them in our markets. We are giving them an answer," said CFTC Chair Michael Selig in a speech Monday at an event held by Fordham University's law school.

A proposed CFTC rule would establish “cryptoasset marketplaces” as a distinct class of regulated entities for platforms offering leveraged products to retail participants. To operate legally, qualifying venues would need to satisfy defined compliance standards, notably anti-fraud protections and verified reserve reporting. The CFTC is also proposing that customer trades on a new category of exchanges be conducted through registered futures fee traders.
