Bihar Chief Minister Nitish Kumar, who was elected to the Rajya Sabha earlier this month, resigned from the state legislative council on Monday, according to news agency ANI. Bihar Minister Vijay Kumar Choudhary told ANI, "CM has been elected as a Member of the Rajya Sabha. So, this (resignation) was a Constitutional necessity...Nitin Nabin is also resigning today. So, Nitish Kumar is also resigning..."

Kumar had filed his nomination papers for the Rajya Sabha on March 5, 2026, in the presence of Union Home Minister Amit Shah. He was then elected to the Rajya Sabha on March 16. According to the Constitution, if a member of the state legislature gets elected to Parliament, he or she must resign the seat previously held within 14 days of the election. Some JD(U) leaders, however, indicated that any change of guard in Bihar could be deferred, citing provisions that allow a person to remain chief minister for up to six months without being a member of the state legislature.
"It is stipulated in the Constitution that you should resign within 14 days. Things will happen accordingly," Sanjay Kumar Jha, the national working president of the JD(U), had told reporters last week. Jha, however, had parried queries on when the 75-year-old JD(U) supremo was expected to step down as chief minister.
