Trademark Infringement: Delhi High Court Rules In Favour Of Tata Power Solar Systems
The Delhi High Court has passed a permanent injunction in favour of Tata Power Solar Systems Ltd. in a case of trademark infringement and misrepresentation.
The Tata Group company had filed the lawsuit against several people who were allegedly using deceptive websites and services to defraud consumers. The plea was filed to restrain the defendants from infringing the trademark of Tata Power Solar Systems.
They were using trademarks and names confusingly similar to those of Tata Power Solar Systems to mislead customers. They were also contacting Tata Power Solar Systems customers by impersonating the company's employees. The defendants were operating online and potentially across multiple locations through their websites and call centres.
A bare perusal of the impugned domain names and email addresses makes it apparent that the defendants have "slavishly copied" the registered and well-reputed trademark, and the products bearing the impugned marks are being used for identical services of solar energy solutions, a bench of Justice Amit Bansal said in an order dated Feb. 13.
The court also ordered one of the entities to suspend the domain name www.tatapowersolarroof.com. It said other people, who were operating the domain names www.tatapowersolardealership.co.in, www.tatapowersolars.com and www.tatapowersolars.org had submitted that they have complied with the directions of the court and suspended the domain names.
The lawsuit was filed on May 16 last year after Tata Power Solar Systems officials came to know about the activities between February 2020 and April 2024.
