The government provides several exemptions and deductions for salaried taxpayers to lower the income tax burden. Among the several exemptions available under the old tax regime, the salaried individuals can use the house rent allowance (HRA) to significantly reduce their total tax liability.
The HRA exemptions can be claimed under Section 10(13A) of the Income Tax Act, 1961. However, to claim the tax benefits on the rent you pay, the HRA needs to be clearly mentioned in your salary slip.
For claiming the HRA exemption, salaried individuals need to produce a few documents and proof of paying the rent while filing the Income Tax Return (ITR).
Documents needed to claim HRA exemption:
HRA component in salary slip
Form 16: The tax deduction details on the HRA amount will reflect in Section B of Form 16.
Rent agreement and rent receipts (at least one for each quarter)
PAN of the landlord if the amount exceeds Rs 1 lakh in a financial year
But what should you do if your landlord does not have a PAN card or refuses to share their PAN card details? Scroll below to find the answer.
What To Do If Your Landlord Does Not Share PAN Details?
If your landlord does not have a PAN card and your annual rent exceeds Rs 1 lakh, then you need to get a declaration from your landlord stating that he/she does not have a PAN card. The declaration must have their name and address.
On the other hand, if your landlord refuses to provide the PAN details, you can write to the Income Tax Department and request your landlord’s PAN card details. For this, you will also need to share the personal details of your landlord.
To conclude, the PAN card details help IT officials verify the rental income declared by your landlord with the income recorded in the tax returns. It ensures that landlords pay tax on their rental income.
