Dharavi Redevelopment Project: Timeline Of 'Reckless' Seclink Case That Bombay High Court Dismissed

Maharashtra CM Devendra Fadnavis has publicly said that terms and conditions of the 2022 Dharavi tender were finalised during the MVA government’s tenure.

The Bombay High Court on Friday upheld the Maharashtra government's decision to award the Dharavi slum redevelopment project to Adani Properties Pvt.

A division bench comprising Chief Justice DK Upadhyaya and Justice Amit Borkar dismissed a petition filed by UAE-based Seclink Technologies Corp., which had challenged the tender. The court ruled that the petition lacked merit and dismissed it accordingly.

Nov. 11, 2018: The Devendra Fadnavis-led erstwhile Maharashtra government issued tender for Dharavi Redevelopment Project.

Nov. 3, 2019: Maharashtra signed MoU with Indian Railways for inclusion of 45 acres of Mahim-Matunga railway land.

March 8, 2019: CEO of DRP/SRA wrote a letter to Seclink Consortium that they are preferred bidder in the case.

June 17, 2019: The state government sought the Advocate General Ashutosh Kumbhkoni's opinion whether inclusion of railway land constitutes material change to the tender conditions or not.

Oct. 25, 2019: Kumbhkoni conveyed his opinion to the state government, stating that, inclusion of railway land constitutes material change in tender conditions, so there is a need to go for fresh bids.

Aug. 27, 2020: Committee of Secretaries accepted the AG’s recommendations and advised the cabinet to cancel the 2018 tender. This happened during the tenure of Uddhav Thackeray as Chief Minister.

Oct. 29, 2020: The Thackeray cabinet accepted advise of COS and cancelled the 2018 tender.

Nov. 5, 2020: The government issued a government resolution confirming the cancellation of 2018 tender and announced to go for fresh bids for Dharavi.

Nov. 24, 2020: UAE-based Seclink filed a writ petition in the Bombay High Court challenging the state government’s decision.

June 20, 2022: Uddhav Thackeray-led Maha Vikas Aghadi government is toppled. Shiv Sena rebel Eknath Shinde assumes office of CM with Devendra Fadnavis as deputy.

Oct. 1, 2022: The Mahayuti government issues fresh tender for Dharavi Redevelopment Project.

Nov. 15, 2022: Bids are opened and Adani Properties Pvt. is declared as preferred bidder.

Dec. 24, 2022: The cabinet approves Adani Group's bid for DRP.

July 17, 2023: The government issues a 'Letter of Award' to APPL.

July 18, 2023: Seclink’s plea for making APPL a party to its petition is accepted by the Bombay High Court.

Dec, 20, 2024: Seclink’s petition is dismissed by Bombay High Court’s Division Bench comprising Chief Justice DK Upadhyay and Justice Amit Borkar.

Notably, the tender for Dharavi Redevelopment Project was issued for the fifth time in 2022, after unsuccessful attempts in 2004, 2011, 2016 and 2018.

Fadnavis has publicly said that terms and conditions of the 2022 Dharavi tender were finalised during the MVA government’s tenure.

In the new tender issued in 2022, bids were to be submitted afresh and Seclink could have submitted fresh bid complying with its terms and conditions. It, however, approached the court with its petition.
