The Insurance Regulatory and Development Authority of India's (IRDAI) action against Niva Bupa Health Insurance could have wider implications for the insurance sector, with Morgan Stanley viewing the move as a positive development for the industry.

IRDAI has directed Niva Bupa not to open any new place of business for six months from the date of its order, following non-compliance related to the expense-of-management (EOM) limits for financial year 2025.

Morgan Stanley said Niva Bupa has since complied with the EOM limits in FY26 and the first quarter of FY27, and remains on track to meet the prescribed limits for FY27.

The brokerage said the regulatory action is important as it evaluates the insurer's compliance with the expense-related framework and the steps being taken to protect policyholder and stakeholder interests.

“We view IRDAI's action on EOM non-compliance as positive for the sector, and it could ease competitive intensity,” the brokerage said.
